You must select one of these texts, and write a critical review of it. The critical review should be written in line with the guidance given to you during the module and in your seminars.
It should address, as appropriate, some or all of the following points:

  1. Accurately summarize the text’s central focus and the key argument(s) advanced by the author.
  2. Explain why the author holds the position that they do.
  3. Critically compare the positions taken by others.
  4. Critically reflect on the different views that exist in respect of the issue at hand. For example, to what extent do different authors hold different views? Are different authors arguing at cross-purposes or is there a meaningful disagreement? What assumptions drive different authors? Do authors appeal to different principles/criteria/theories, or perhaps different understandings of the same principles/criteria/theories?
  5. Evaluate whether adopting the author’s position would improve the law. When considering whether the position would improve the law, you should consider some or all of the following:
    (i) The extent to which it is consistent with existing law;
    The extent to which it would require a change in law;
    (iii) Whether it would achieve some particular purpose or otherwise be more ‘just’ than alternatives; and
    (iv) The practicability and other implications of adopting the position.

You must communicate arguments clearly and in a manner appropriate for legal scholarship. You will be expected to identify and make appropriate use of a range of primary and secondary sources to support your critical review of the selected text.
